One of the Justices of the Supreme Court who are hearing the 2012 election petition yesterday questioned the motive of Tony Lithur, counsel for John Dramani Mahama, for the persistent interjections he was making in defence of the Electoral Commission.

“Ever since this case started, I have noticed that anytime the petitioners object to something that the 2nd Respondent is doing in relation to their cross examination you [Tony Lithur] seem to be more interested in defending the EC than the EC’s own counsel, why?” Justice Baffoe Bonnie quizzed.

Justice Baffoe Bonnie’s observation followed Tony Lithur’s interjection after counsel for the petitioners had objected to the tendering in of a collation sheet from the Atebubu Amantin constituency as evidence by the EC. The petitioners’ objection which was later upheld.

Tony Lithur had to apologize for interfering in the EC’s cross examination and sated that he never sought to do the work of the counsel for the EC, but was only trying to explain the relevance of the document that the EC was trying to introduce in the cross examination.

It will be recalled that since the election petition was filed on December 28, 2012, the EC, NDC and John Mahama, who are the three respondents, have been on the same side when it comes to each respondent’s excuses, objections and defence.
