Former Attorney General, Ayikoi Otoo has filed a fresh contempt suit against the Electoral Commission.

This is a follow up to the withdrawal of the earlier contempt suit he filed at an Accra Fast Track High Court following the withdrawal of the controversial C.I 73 from parliament.

In an interview with Citi News, Lawyer Ayikoi Otoo maintained that the basis for which the Electoral Commission wants to go ahead with the creation of additional 45 constituencies is illegal.

He condemned the EC for supervising the NDC primaries that sought to get candidates to contest the proposed additional 45 constituencies.

“Why should the EC supervise the conduct of primaries for the proposed additional 45 constituencies when the matter is pending in court; when we say the EC is in bed with the NDC they deny.”

According to Ayikoi Otoo the EC must come clear on some of the factors it considered in the creation of the constituencies.

The controversial Constitutional Instrument (C.I) 73 creating 45 additional constituencies was withdrawn following the recommendation by the Subsidiary Legislative Committee of Parliament which pointed out some errors in the C.I 73.

In view of the C.I 73’s withdrawal, the former Attorney General also withdrew the contempt suit filed by the former Attorney General at the Accra Fast Track High Court.

The former AG stated that he was compelled to file a fresh contempt suit against the EC after it laid an amended CI to seeking the court’s authorization to go ahead with the creation of the additional 45 constituencies.

He quoted Article 47 (3)(4) of the 1992 Constitution as providing guidelines to which the EC may use in creating the new constituencies.
